Shooting leaves brother hospitalized ~ A Bottle of Rum
A Libby man allegedly shot his brother early Christmas morning in an altercation over a bottle of rum.Austin Zugg, 32, was listed in stable condition at St. John’s Lutheran Hospital after he was shot in the abdomen allegedly by his 35-year-old brother, Kolby Zugg.Kolby suffered minor injuries after the incident and was briefly hospitalized. Kolby allegedly shot Austin at 1 a.m. Christmas morning at their parents’ home, six miles south of Libby at the old Branding Iron bar.

Libby Fails Latest Federal Air Quality Test

Libby’s air quality falls below
the federal 24-hour fine particle
standard, according to a report
released last week by the Environmental
Protection Agency.
The EPA designated Libby as a
“nonattainment” area, one of 211
counties or parts of counties in the
United States whose air quality
violated the 24-hour fine particle
federal standard from 2005-07.
A fine particle, or PM 2.5, is
about 1/30th the size of an average
human hair. In September 2006,
the EPA tightened the 24-hour PM
2.5 standard from 65 to 35 micrograms
per cubic meter.
The EPA’s findings were first
reviewed by state and tribal governments
before being finalized
and released.
During the summer, fine-particle
concentrations in Libby typically
averaged less than the EPA standard,
but in the winter — November
through February — concentrations
were “well above the standard,”
according to the EPA.
The EPA attributed the higher
concentrations in Libby to stagnant
winter weather conditions,
strong temperature inversions,
light winds and wood-stove emissions.
Libby is in a bowl-shaped valley
that lends itself to temperature
inversions that can cause pollution,
such as smoke from wood
stoves, to get trapped close to the
ground.
High concentrations of fine
particles can aggravate heart and
lung diseases and have been associated
with a variety of serious
health problems including heart
attacks, chronic bronchitis and
asthma.
“Over the past several years,
local and state agencies have made
great strides in their work with
Libby citizens to reduce PM 2.5
levels,” said Carol Rushin, EPA
Region 8’s acting regional administrator.
“Unfortunately, for the time
period reviewed, those measures
have not been enough to bring
air pollution levels in Libby into
attainment of the PM2.5 standard.”
Libby’s “nonattainment” designation
will not be effective until April 2009, giving the state
an opportunity to provide more
recent 2008 data to the EPA for
consideration.
State and county officials initiated
a wood-stove changeout program
from June 2005 to April 2007
in which more than 1,000 woodstoves
used to heat homes were
either replaced or repaired.
Each cleaner-burning EPA-certified
stove produces an average of
70 percent less pollution, according
to the EPA.
An air quality alert that prohibited
the use of wood-burning
stoves went into effect in Libby
for nearly three days in late October.

Henson trial: Brother testifies for prosecution
Heather Henson’s 14-year-old brother testified Thursday that his sister spoke of killing Larry Kingsley just hours before the fatal shooting on July 12.“She might have to kill Larry if he came at her in a threatening way,” Henson’s brother testified while appearing as a witness for the prosecution.He also told the court that his sister told him that Kingsley had threatened her and Stephen Thomas, pulled a knife on Thomas, and shot guns in the air every night. When asked why he didn’t notify anyone of Henson’s statements at the time, the young teen responded, “because she says weird stuff all the time.”
Henson is being tried for deliberate homicide, physical evidence tampering and felony theft.The day of the murder, police spoke twice to Thomas and once to Henson. Neither time did they indicate that they were in trouble or feared for their lives, according to testimony by Deputy Jason Place of Lincoln County Sheriff’s Office.

Meth Dealer Put in Jail ?
I Sure am glad that North Idaho is looking out for Lincoln County Montana.
Lincoln County over the years has need successfully been able to "put away" Meth Dealers or to really even slow down use. the Rumor Mill of course talks of Pay Offs, Dirty Deals and the Usual Speculations. year after year passes, the Good Cops put the Dealers in Jail and somewhere along the way the system let's them slip away, especially if they own real estate.
I have first hand experience as a Real Estate Broker owner being asked to do a Market Analysis on a Drug Dealers property so that they could use the property as collateral to get out of jail. Many things Contribute to the lack of accountability for Known Drug Use in Lincoln County. In Eureka there is a know drug dealer that everybody knows has dealt drugs for at lease 14 years - prove that, anyway he has been driving the local school bus for years.. no body cares.... He even uses the bus to stop and get groceries most every night on the way home, your tax dollars at work. Many Drug Dealers are known in Lincoln County and Have been for 20 or 30 years and the SHOCK of it all is that you know the Cops know but for some reason arrests just can't stick...

Now for Some Reason and thankfully so, North Idaho - Sandpoint - Coeur d'Alene - gets a hold of our Notorious Drug Dealers in Lincoln County and they convict them... Here is the Latest News on that topic...
Court Upholds Meth Conviction

SANDPOINT - Idaho's court of appeals has affirmed a Montana man's conviction on methamphetamine trafficking charges in Bonner County.Eddy Max Grantham claimed his 2005 trial was so marred by procedural errors and misconduct that the judgment against him should have been reversed, according to court documents.

A jury convicted the Libby man and District Judge Steve Verby subsequently sentenced Grantham to serve three to seven years in state prison.Grantham, 52, was a passenger in a vehicle stopped for erratic driving on U.S. Highway 95 north of Ponderay on Jan. 13, 2005. The vehicle was searched after driver Shelby Ranay Wilkes gave conflicting statements about the purpose of her trip. Both suspects appeared unkempt and gaunt and both had pock marks or lesions on their faces, court documents say.
During the stop, Deputy Mark Strangio had dispatchers here call authorities in Lincoln County, Mont., for information on Grantham and Wilkes, 25. Dispatch reported back that the pair was suspected of drug activity there.An ensuing search of the Isuzu pickup uncovered an ounce and a half of the stimulant and intravenous drug paraphernalia, court records indicate.
Wilkes later took a plea deal which converted the trafficking charge to simple possession. She was sentenced to two to four years in prison with a shot at probation after serving six months. Wilkes also went on to testify against Grantham at his trial.In his appeal, Grantham argued that the lower court erred by not granting a motion to suppress evidence.

He maintained the deputy lacked a reasonable and articulable suspicion that criminal activity was afoot and had merely profiled him as a meth user based on his appearance and that of the truck, which was described as "ratty."Grantham's home in Libby was also searched and an undisclosed amount of drugs were discovered, although the state and defense agreed to keep that evidence from jurors at trial.Grantham asserted that a defense motion for a mistrial should have been granted after a Lincoln County detective indicated to jurors that drugs were found in the home.

Jurors were instructed to disregard the offending answer and question. Grantham further argued in the appeal that misconduct was committed when former Deputy Prosecutor Jim Stow asked about marks on the defendant's inner arms when he was cross-examined at trial. Grantham denied they were drug-injection sites...

I know this is harsh, but as a life long resident of Lincoln County Montana I know that Drugs and the underground economy created by Meth and the Dealers and those who play the games with them is simply, so far, un-Stoppable.

Libby Roads
So much money that Lincoln County has, yet reports of Driving from Libby to Kalispell claims that Flathead COUNTY does a way better job at clearing the roads, why? Lincoln County has a HEFTY budget, but where does that money really go. In Eureka, Lincoln County pays over 100,000 to remove snow from the airport runway, there is rarely snow there.. yet for some reason it is seemingly unsafe to Drive from Libby to Kalispell because of the way the County Maintains the Roads, Why?
