"Jason Stverak, president of the Franklin Center for Government and Public Integrity, recently wrote a Washington Examiner op-ed regarding the free speech threats which bloggers and other citizen journalists increasingly face.

This past December, federal judge Marco Hernandez of Oregon issued a ruling in the libel trial of Obsidian Finance Group v. Cox that has dangerous First Amendment implications.

Hernandez ruled that blogger Crystal Cox was not entitled to the same protection under media shield laws that other members of the press enjoy. This ruling made it easy for a jury to find her guilty of libel. That result threatens the First Amendment rights of all citizen-journalists.

With the Internet increasingly serving as the dominant source of information, a national debate has been taking place asking the question, who is a journalist? Legal scholars, journalism academics and First Amendment advocates all have their opinions and as expected, there is little agreement.

But why is this issue so complicated? Bloggers, like all citizens of the United States, have First Amendment rights. Has the definition of a journalist changed? Or has perception and therefore legal definition simply not adjusted to modern technology?

According to Professor Kyu Ho Youm of the University of Oregon School of Journalism and Communication, Judge Hernandez “ruled correctly” in the Cox case. But he also acknowledges that the ruling was based on his “textual interpretation” and that “pre-Internet law needs updating.”

Youm offers a wake-up call to state legislators. Media shield laws must be revised to make clear that bloggers and all citizen-journalists deserve the same protection as the city hall beat-writer at the local newspaper.

This is especially important, as technology and new economic realities have forced newspapers all over the country to cut staff drastically and in many cases, close up shop. The public now relies on citizen-journalists to perform an invaluable service to our democracy — serving as government watchdogs.

"A security guard at North County Fair in Escondido has come under fire in recent weeks for allegedly using physical force against people at the shopping mall, two of whom were off-duty police officers.

Complaints about the conduct of the security guard, Darrell Potts, are contained in two lawsuits that have been filed in Vista Superior Court. Also named as defendants are May Centers Inc., which manages the mall and employs Potts; and Ernest W. Hahn, Inc., the developer and owner of the mall.

In one of the suits, Sheriff's Deputy Jay Sheffield and Escondido Police Officer William Wolfe accuse Potts of false imprisonment, assault and battery, and invasion of privacy.

Sheffield and Wolfe state they were walking in the mall on April 22 when Potts forcibly detained Sheffield by grabbing his arm and twisting it behind his back. Potts also threatened Wolfe with physical violence if he left the premises, according to the suit.

The two men state that Potts implied that they were detained on suspicion of shoplifting.

A plainclothes police officer and a uniformed security guard came to assist Potts and participated in frisking Sheffield and Wolfe, the suit says. The two men were never charged with a crime. Sheffield and Wolfe claim they also suffered humiliation and embarrassment when they were forced to identify themselves as police officers in front of a crowd that had gathered around them.

The two are seeking $1.25 million in punitive damages and an unspecified amount for general damages. The other lawsuit was filed by Sharon Rose Ferravanti who stated that on July 9 in the mall Potts placed her in a choke hold, "rendering (her) immobile and nearly unconscious." Ferravanti's attorney, Charles Renshaw of Escondido, said the altercation followed an argument between Ferravanti and Potts over her car being towed.

Ferravanti had become angry and thrown papers from Potts' desk into the air, triggering his use of force, Renshaw said. Ferravanti -- who Renshaw said is 5 feet 3 inches tall to Potts' more than 6 feet in height -- is seeking $1 million in punitive damages and an unspecified amount in general damages and expenses. Frank Daly, North County Fair manager, would not comment on whether Potts is still employed at the mall. End-of-Story "

"The Montana Supreme Court last week denied a new trial for a woman convicted of attempted mitigated deliberate homicide in the July 2008 shooting murder of a 67-year-old man at a Sylvan Lake campground south of Libby.

The court upheld 19th Judicial District Court Judge Michael Prezeau’s decisions in the December 2008 trial that led to the conviction of Heather Michelle Henson, who was 19 when the shooting occurred.
Henson testified in trial that she and boyfriend Stephen Michael Thomas – who was 17 at the time – killed Larry Kingsley in self-defense after he had become increasingly unstable.

Henson was sentenced to 20 years in prison, with all but five suspended, and a jury acquitted Thomas of homicide charges in a separate trial."

"BILLINGS (AP) — A hearings officer said state child protective services workers violated the rights of a disabled Livingston woman and retaliated against her when she complained about an investigation into whether she could properly care for her child.

In a 49-page ruling issued last week, Terry Spear, a hearings officer with the state Department of Labor and Industries, found that employees with the Child and Family Services Division of the Montana Department of Public Health and Human Services violated state anti-discrimination laws when they began an investigation without good cause into whether Geri Glass could properly care for her newborn son.

The senior Republican on the Judiciary Committee is demanding answers from the Obama administration over the Food and Drug Administration's retaliation against whistleblowers who contacted his office.

Six current and former FDA employees sued the government last week alleging that the agency pried into their personal email accounts and retaliated against them after they shared with Congress concerns about the approval process for medical devices.

Sen. Charles Grassley (R-Iowa), a longtime champion of whistleblower rights, on Thursday released a letter that warns that FDA officials could be breaking the law by retaliating against the whistleblowers, at least one of whom was fired.

"It is troubling to me to see your Agency actively pursue the dismissal of an employee … not because they violated procedure and leaked genuinely confidential classified information, but simply because you 'cannot trust him'," Grassley wrote to FDA Commissioner Margaret Hamburg. "During your confirmation hearing in the Senate in 2009 you stated, 'I think whistleblowers serve a very important role in government in surfacing critical issues and concerns and making sure they're addressed. As leader of the FDA, I would very much want to create a culture that enables all voices to be heard'"

As with the Peter Sivere Story, and so many others I hear of where whistleblowers are retaliated against by governement agencies, this is a major statement and a win for whistleblowers everywhere.

Sure sounds like Kingsley should have had social workers involved, and the police knew.

There was more testimony that Kingsley was threatening them and controlling them, keeping them hostage per say and still Heather Henson is charged with murder?

"Henson and Thomas were then picked up by William Sterling Goodrich, who was headed to Kalispell and agreed to take them to Sylvan Lake. Goodrich testified that they told him Kingsley was "crazy" and that he was concerned about what he might be getting into.

Goodrich said they ran into Kingsley, who was driving in his truck, as they were nearing the campground. "He said something about, ‘I was just coming to look for you,’" Goodrich said.

Goodrich said he accepted an offer of a shot of whiskey from Kingsley. Kingsley told Thomas to shoot the vent pipe on the outhouse at the campground, and Thomas refused. He held a knife to Thomas’ throat and told him, "‘Do what you’re told, corporal,’ or something like that," Goodrich recalled.

"I was ready to go right then," Goodrich said, but he waited for Henson and Thomas to collect their things. As Henson was putting her belongings into Goodrich’s truck, Goodrich asked Kingsley if she could leave with him. Kingsley refused, and Goodrich asked him why.

"He said, ‘Because I’m the master,’ so I shut up," Goodrich said. "What do you say to that?"

Kingsley tried to get Henson to perform a sexual act on Goodrich, who told him he was "sick."

"He said ‘You need to leave peacefully. You need to leave now, peacefully,’" Goodrich said.

Goodrich said he felt bad about leaving Henson and Thomas behind, "like I was letting them down or something." Kingsley said he had been "prepared to kill 200 people to find us," Thomas said.

After Goodrich left, Kingsley told Henson she would "mate with him" and "take his seed" or she would die, Thomas said. While the three were sitting around the campfire and shooting guns in the air for Kingsley’s alleged fallen comrades, Henson passed Thomas a note written using the text messaging feature on a cell phone. She wrote, "I think we’re going to have to shoot him to get out of here," Thomas said."

I heard this same thing I believe in the Zugg shootings, where police were asked to go with and help people retrieve belongings and they refused and people were shot.

"Kingsley dropped Thomas off at the magic show and returned to his campsite. After the show, Henson called the dispatcher at the county sheriff’s office and tried to get an officer to take her back to Kingsley’s camp to retrieve her belongings. According to dispatch records, Henson called at 6:12 p.m. and again at 7:06 and 7:54. The phone calls were recorded and played for the jury.

During the first call, Henson was told that all officers on duty at the time were tied up at the scene of a bad traffic accident but that an officer would be contacted and asked to call her. When she called the second time, she was told that the officers were just getting clear from the accident scene.

During her third call, Henson was kept on the line while the dispatcher radioed an officer, who said he would be at the sheriff’s office in about 20 minutes and would call Henson then.

But Henson decided to hitch-hike back to the campground to get her things, Thomas said.

"That was everything she had," he said.

Thomas said he was worried because Kingsley had already threatened to kill him if he didn’t leave Henson, but "we figured if we had a witness maybe Larry wouldn’t act all crazy.""

Police Ignored and Could have Helped.  Libby Montana Police and Law Enforcement were negligent from their first encounter with these 3. 

Get All Police Complaints, Use FYI, if they have hid them or thrown them away they will have criminal charges.

"Police officers who responded to the complaints stopped Kingsley’s truck a short distance from Radio Shack but let him go with a warning after finding he had no outstanding warrants. Thomas said one of the officers told him Kingsley was "a bad person" and that he should stay away from him."

This is True, there were campers that reported this same thing to the Lincoln County Sheriff Office that same summer and they ignored this information. We were running a recall for Sheriff Daryl Anderson and one of our people had a message left by the campers of the same story and that they went to the Sheriff. Larry Kingsley did not have to die, the Lincoln County Sheriff Office should have arrested him, got him help BEFORE this happened.  It was wrongful death and their negligence is to blame.

Kootenai National Forest, the United States Forest Service soon to be sued for Wrongful Death and Wrongful Incarceration

Bernie Cassidy, Jay Sheffield, Roby Bowe, and the Unstoppable Culture of Corruption of Lincoln County Montana.

Sylvan Lake Campground, Kootenai National Forest Death of Larry Kingsley - Bernie Cassidy, Jay Sheffield and the Corruption of Lincoln County Montana could have prevented it all.

Bernie Cassidy Personally and Professionally, the Lincoln County Sheriff Office, Lincoln County - Bonds, Insurance and All - Jay Sheffield, and all involved in Libby Montana in the arrests, cover ups, and events leading up to the Death of Larry Kingsley will be sued for wrongful death and wrongful incarceration.  They will brought up on criminal charges, conspiracy charges, and they are to blame for the death of Larry Kingsley and could have prevented this situation long before it happened.

When they are all sued, Bernie Cassidy and the Legacy of Corruption left behind by Sheriff Daryl Anderson will cover it up, they will get corrupt judges like the ex Libby Judge Michael Prezeau (who will also be sued and brought up on criminal charges) anyway, when they pull all their strings all the way to the top of Montana Corruption where it is pay to play and a known fact they say, that a Supreme Court Decision in Montana costs $50,000.  Anyway, they will call in commissions, governors, congressman and cronies past and present to cover up their lies and corruption that create a trail of victims decade long, and there will be NOTHING they can do to stop a full out investigation, even their Montana FBI connections, border patrol connections and Forest Service Cop connections won't stop it..

You see they will all be named in the lawsuit however the one really being Sued, also being sued will be the Kootenai National Forest, the United States Forest Service and this lawsuit will be filed federally and the Kootenai National Forest, the United States Forest Service will investigate all the action in this crime, conspiracy and cover up to save themselves from paying a massive lawsuit for Wrongful Incarceration to Heather Henson and Family .. and Wrongful Death to the Kingsley Family.

They will turn up the fact that Jay Sheffield was never legally a cop in Lincoln County and then how this cop, not a cop that pulled them all over and knew the situation.. well he became a JUDGE in Lincoln County serving up Justice in the same cases that he was the "officer".  Bernie Cassidy's illegal behavior for decades will turn up, and the the Kootenai National Forest, the United States Forest Service will pay for it to prove their own innocence in this situation.  So stay tuned.  Heather Henson and the Kingsley family are not forgotten, and not alone, NOT on my watch.

"Bail for a Kalispell teen charged with murdering a 67-year-old man at a campground southeast of Libby was set at $250,000 Thursday during an initial appearance in Lincoln County Justice Court.

Heather Michelle Henson, 19, is facing a charge of deliberate homicide.

is accused of using a rifle and a .22-caliber pistol to shoot Larry M. Kingsley approximately 16 times after a confrontation over sex, according to investigative reports.

Drugs and alcohol were involved.

Henson told investigators she met Kingsley on July 8 at a bar in Libby, where Henson agreed to accept $2,300 to help launch her career as a writer. But when Henson lost the money, Kingsley implied she would have to repay him with sex.

Henson and her boyfriend, Stephen Michael Thomas, 17, of Kalispell went with Kingsley to his campsite on Sylvan Lake, located about 30 miles southeast of Libby in the Kootenai National Forest.

Henson said she had sex with Kingsley, but that over the course of several days he became increasingly jealous of Thomas. Henson said she awoke one morning to see Kingsley holding a knife to Thomas’ throat because she “belonged” to Kingsley now.

On the night of July 12, Henson told authorities she was firing a rifle into the air but then turned the weapon on Kingsley and loosed a round at his head. Kingsley, who was sitting in a chair by the campfire, didn’t open his eyes, so Henson aimed at his chest and began firing again.

Thomas also shot at Kingsley, according to Henson.

Henson said she believed her life was in danger and that Kingsley would have killed her if she hadn’t shot him.

After the shooting, Henson and Thomas returned to Kalispell and left a message with a family member saying they had just killed a man. The family member notified authorities, who found Kingsley’s body early on the morning of July 13.

Thomas is charged with deliberate homicide, tampering with physical evidence, and felony theft. Thomas will be tried as an adult in Lincoln County District Court, Lincoln County Attorney Bernard Cassidy said.

Henson also could face additional charges, Cassidy said.

Current Montana Laws do not do enough to protect our children. Sometimes, the parents are also ignored, or wrongly targeted, despite compelling circumstances. There are very limited resources or advocacy to assist a child, or parent. We are trying to change that NOW!!!

Presently, according to Montana Child Protective Services, it's not illegal to beat your child unless you leave a visible mark. Montana CPS will only get involved if an alleged abusive parent causes one or more of the following;

1. The loss of sight in one or both eyes.

2. Internal organ damage.

3. Broken bones.

4. A visible mark.

5. DEATH.

6. Medical, dental, or emotional neglect or endangerment means nothing.

According to CPS, bruising is not consistent with child abuse. Neglect or the infliction of emotional damage to a child is simply ignored and not enforced.

Law Enforcements hands are tied and Police are left waiting for hours for any response to an abuse crime. Police, as well as caring parents are forced to call a CPS toll free number, only to reach untrained and often uncaring personnel. The chance that any allegation of abuse will receive the proper attention that is needed in a "Reasonable timely manner," is slim and unlikely. A seasoned career Police Officer states," I've been here for twenty years and I still don't know what CPS does for a living."

Children's Rights Montana wishes to change this by pro-active involvement and help enable children or parents to become involved. We cannot appoint you legal counsel, or give you legal advice, but we can direct you to organizations that may assist you.
